Hima Bindu, learned Counsel appearing on behalf of Sri Venkata Subbaiah V, learned Counsel for the Petitioner and Sri G. Raju, learned Counsel for the sole Respondent. 2. Sri G. Raju, learned Counsel for the Respondent, has drawn the attention of this Court to the Reply Affidavit dated 09.09.2025 filed by Sri Peeyush Kumar, who is now working as Principal Secretary to Government, Finance Department. Para 7 of the said Reply Affidavit filed by the Respondent would indicate that an amount of Rs.3.98 crore has already been paid to the Petitioner Association. The receipt of this amount by the Petitioner Association is confirmed by the learned Counsel appearing for the Petitioner. The Reply Affidavit would also indicate that the remaining amount due to the Petitioner to an extent of Rs.9.18 crore could not be cleared as the bills are not yet raised. Para 9 of the said Reply Affidavit dated 09.09.2025 is usefully extracted hereunder: “9. In view of such huge liability, it is submitted to the Hon’ble Court that the Government undertakes to honour the legitimate balance amounts of the petitioners on priority. The current fiscal position will not allow for the payment of the dues mentioned at para 8 above, without compromising on other priority expenditure of the state. It is submitted to the Hon’ble court that the Government is clearing the bills related to GPF and APGLI that are due to employees regularly. Therefore, it is humbly requested to permit the Government to clear the dues related to the petitioners approximating Rs.9.18 Cr. on First in First Out (FIFO) basis by December 2025. (Emphasis supplied)” 3. The above extract would indicate that the Official Respondents are seeking time up to 31st December, 2025 to pay the balance amount of Rs.9.18 crore. Having recorded the same, this Court is of the opinion that the written request made by the Respondent through the Reply Affidavit dated 09.09.2025 is just and reasonable. 3 4. Accordingly, the Respondent is directed to clear the balance amount of Rs.9.18 crore and pay the same on or before 31st December, 2025. It is also clarified that any transfer of the sole Respondent (Sri Peeyush Kumar) during the interregnum would not absolve him of the undertaking given by him. 5. With these observations and directions, this Contempt Case is closed. 6. Liberty is granted to the Petitioner Association to move an appropriate Application for reopening of this Contempt Case if the undertaking given by Respondent is not complied with within the scheduled time. 7.
