Neutral Citation No. - 2025:AHC-LKO:1113 Court No. - 8 Case :- WRIT - C No. - 11400 of 2024 Petitioner :- Ram Surat Respondent :- State Of U.P. Thru. Secy. Revenue Deptt., Lucknow And 14 Others Counsel for Petitioner :- Rakesh Kumar Modanwal Counsel for Respondent :- C.S.C.,Mohan Singh,Vijay Bahadur Yadav Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of respondent nos.1 to 4 has been accepted by the ofÏce of learned Chief Standing Counsel. Shri Mohan Singh, has accepted notice on behalf of respondent no.5. Shri Upendra Singh, learned Standing Counsel has raised
preliminary
objections
regarding maintainability of the writ petition, to state that by means of the instant writ petitioner has assailed the interlocutory order passed in appeal emanating from the proceedings initiated under Section 24 of the U.P.Revenue Code, 2006. It is urged that the petitioner has an adequate statutory remedy of filing revision and the instant writ petition for the aforesaid reason, may not be argued.
Learned counsel for the petitioner attempting to refute the aforesaid objections, has submitted that the manner in which the impugned orders are being passed, are not in consonance with law. In this view of the matter, for the reason that as the petitioner has an alternative statutory remedy, as provided under the law, this Court is not inclined to entertain this writ petition. Accordingly, this petition is dismissed leaving it open to the petitioner to avail the appropriate
remedy provided under law. OfÏce is directed to return the certified copies of the Annexures annexed with the writ petition, after obtaining the photocopy of the same on record.
