The applicant has preferred this First Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 527/2024, registered at Police Station-Kurud, District-Dhamtari (CG) for the offence punishable under Section 103(1), 296(b), 115(2), 351(2), 191(2) of BNS, 2023. 2

The prosecution story in brief, is that, the complainant Omkar Sahu on 23.12.2024 has lodged a written complaint at Police Station Kurud, alleging that the applicant along with other co- accused persons had killed the deceased Kartik Ram Patel who was the friend of complainant. The allegatins was that the accused along with his two friends have looted some bags of paddy from the house of one Bhikham Sahu and they were caught by the villagers of Village Sirsida and they had beaten the deceased Kartik and his friends with hand, fists and stick and later on Kartik died on 23.12.2024 at about 12:30 PM at District Hospital. 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. The applicant is in jail since 24.12.2024, charge sheet has been filed and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. He further contended that the name of Ramesh Sahu is Rameshwar Sahu whose name is mentioned in the FIR. 5. I have heard learned counsel for the parties and perused the case diary. 6.
Considering the facts & circumstances of the case, nature &
3 gravity of the offence, material available in the case dairy, particularly to the fact that the FIR contains the name of Bhikam Sahu, Nohar Sahu, Buddheshwar Sahu, Premu Kumar Sahu, Kishan Sahu, Virendra Sahu, Toran Sahu, Ramnath Sahu, Ramesh Sahu, Bhanbai Sahu, Geetanjali Sahu and Shahikala Sahu, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Rameshar Sahu involved in Crime No. 527/2024 under Sections 103(1), 296(b), 115(2), 351(2), 191(2) of BNS, 2023 at Police Station-Kurud, District- Dhamtari, Chhattisgarh, is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 8. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
