Heard counsel for the parties and perused the pleadings. Against the dismissal of Section 5 application by the First Appellate Court, a revision had been initially preferred before this Court by the applicant. The revision had been dismissed, as not being maintainable. It is after the dismissal of the revision that the present appeal has been filed. From the aforesaid, it is evident that applicant was pursuing remedies available to him in accordance with advice given by his counsels. No fault or lack of diligence can be found with the applicant in pursuing remedies available to him. For the aforesaid bona fide reasons, delay in filing the present appeal is condoned.
