Applicant Manoj Yadav, who is a charge sheeted accused, has approached this Court by means of present application under Section 528 B.N.S.S. with the following prayer:- "It is, therefore most respectfully prayed that this Hon'ble Court may graciously be pleased to allow the present application and quash the order dated 18.12.2024 in Session Case No. 368 of 2023 Under Sections 323, 504, 506, 376D of IPC and Section 5(g)/6 of POCSO Act, arising out of Case Crime No. 191 of 2022, Police Station-Chitbaragaon, District- Ballia, and further direct the court below to recall the prosecution witness P.W.1 (victim of the case), and/or pass such other and further order, which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case." After some argument, the learned counsel for applicant fairly submits that he does not wish to press this application any further. Accordingly, this application be dismissed as withdrawn. Learned A.G.A. representing State opposite party 1 has no objection to the prayer made by the learned counsel for applicant. In view of above, this application is, accordingly, dismissed as withdrawn. Interim order, if any, stands vacated.
