1. Heard.
2. The petitioner claims to be the wife of late Santosh Kumar who is said to have died on 13.02.2024. The petitioner claims inclusion of her name in the family register.
3. Remedy, if at all, is under Rule 6 of the U.P. Panchayat Raj (Maintenance of Family Registers) Rules, 1970. The petitioner may avail the same unless it has already been availed.
4. At this stage, petitioner's counsel says that an application was submitted to the Sub Divisional Magistrate. However, as per the Rules, the authority competent is the Assistant Development Officer (Panchayat), therefore, the petitioner should move an application before the said authority. Moreover, learned standing counsel says that the Panchayat Secretary has submitted an adverse report. We do not wish to go into these controversies. The petitioner may avail the remedy prescribed.
