The applicant has preferred this application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 559/2023, registered at Police Station – Khamtarai, VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.04.17 15:59:46 +0530 2 / 3 District – Raipur (C.G.) for the alleged commission of offence punishable under Section 67-B of the Information Technology Act. 3. According to the prosecution's story is that obscene photograph has been uploaded by the applicant on his whatsapp through his mobile and hence the concerned police station has been registered aforesaid offences against the applicant on the basis of merely suspicious. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He further submits that the applicant has neither been uploaded obscene photograph in his mobile nor committed any aforesaid offences as alleged by the prosecution against him and applicant has no previous criminal antecedent, therefore, he prays for grant of anticipatory bail to the present applicant. 5. On the other hand, learned State counsel opposes the submission made by the learned counsel for the applicant. He further submits that the present applicant has posted some obscene video over social media. Therefore he is not entitled for grant of anticipatory bail. 6. I have heard learned counsel for the parties and perused the case diary. 7. Considering the nature and gravity of the offence and material on record in the case diary also considering the fact that the present applicant has posted some obscene videos on social media, 3 / 3 therefore, I am not inclined to grant anticipatory bail to the applicant. 8. Accordingly, the anticipatory bail application of the applicant – Ravi Kumar Sahu, involved in Crime No. 559/2023, registered at Police Station – Khamtarai, District – Raipur (C.G.) for the alleged commission of offence punishable under Section 67-B of the Information Technology Act, is rejected.
