Neutral Citation No. - 2025:AHC-LKO:328-DB Court No. - 2 Case :- WRIT - C No. - 10893 of 2024 Petitioner :- Raghvendra Pratap Singh Respondent :- State Of U.P. Thru. Prin. Secy. Panchayati Raj Deptt. Lko. And 3 Others Counsel for Petitioner :- Dharmendra Singh Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Brij Raj Singh,J.
1. Heard. 2. On 20.12.2024, the following order was passed:-
"Heard Shri Dharmendra Singh, learned counsel for the petitioner and Shri Manish Mishra, learned Additional Chief Standing Counsel for the State. We have gone through the contents of the impugned order. The order admits to water logging in front of the house on account of non construction/ non installation of a U-Type drain. Surprisingly, the representation has been rejected by the District Panchayat Raj Officer, Unnao (hereinafter referred to as 'the D.P.R.O., Unnao') presumably for want of funds. This is hardly a matter where the representation should have been dismissed. It is highly insensitive of the D.P.R.O., Unnao to have done so. He should have kept the matter pending and sought requisite funds from the concerned to get the construction done. The report of the D.D.O., in fact, recommends construction of the drain yet the D.P.R.O., Unnao has rejected the representation. Let the D.P.R.O., Unnao appear in person before this Court on
03.01.2025. In the meantime, requisite funds shall be made available for construction of the aforesaid drain and the Collector, Unnao shall ensure the same. Every efforts should be made to start the construction of drainage before the next date. The Collector, Unnao shall also join the proceedings through video conferencing. List/ put up on 03.01.2025. Let a copy of this order be provided to the learned counsel for the parties within 24 hours on payment of usual charges. "
3. After passing of the order dated 20.12.2024, U type drain etc
has been constructed. Petitioner's counsel says that greivance has been redressed. 4. Let a copy of order dated 20.12.2024 and this order be sent to Director, Panchayat Raj, U.P. so that he may counsel the earlier DPRO who had passed the order dated 22.12.2023, namely, Sri Nirish Sahu in the light of our observations made in the order dated 20.12.2024. We make it clear that observations shall not be treated as adverse to the career of Sri Sahu but he certainly requires counseling. 5.
Sri Gau Ram Rathi, District Magistrate, Unnao has joined the proceedings through video conferencing. He ensures that he will counsel other officials in his district in the light of the aforesaid. 6. Accordingly, the petition is disposed of. (Brij Raj Singh,J.) (Rajan Roy,J.) Order Date :- 3.1.2025 Shanu/- Digitally signed by :- SHANU SUMAN High Court of Judicature at Allahabad, Lucknow Bench
