2025:JHHC:11640 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.3930 of 2024 ------ Md. Rustam Ansari @ Rustam Ansari, son of Nijamuddin Ansari, resident of Village Kishanpur, P.O. & P.S. Margomunda, District Deoghar. … … Petitioner Versus The State of Jharkhand. … … Opposite Party ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Sudhanshu Kumar Deo, Advocate For the State : Mr. Rakesh Kumar Sinha, A.P.P. ----- 08/ 17.04.2025 This anticipatory bail application under Section 438 and 440 of the Code of Criminal Procedure, has been preferred by the petitioner apprehending his arrest in connection with Margomunda P.S. Case No.33 of 2024, for offences under Sections 25 (1-B)(a), 26 and 35 of the Arms Act. The case is presently pending before the Court of learned Judicial Magistrate, 1st Class, Madhupur. 2. Heard learned counsel for the petitioner and learned counsel for the opposite party – State. 3. Opportunity was granted to the State to oppose the anticipatory bail, which the State availed and opposed. 4. It is alleged that from one house, illegal arms were recovered, which were concealed. One Rubiya Khatoon was arrested and she stated that this petitioner who happens to be her brother-in-law, used to give her those arms for selling and she used to sell the same. 5. Though the petitioner is stating that the house does not belong to him but the same is a matter of investigation, which needs to be properly investigated. The fact remains that from the 2025:JHHC:11640 2 house, illegal arms were recovered and it is the lady accused who had taken the name of this petitioner to be one of person who was involved in buying and selling of illegal arms. 6. Thus, it is not a fit case for grant of anticipatory bail. 7. Accordingly, this Anticipatory Bail Application is dismissed. (ANANDA SEN, J.) Prashant. Cp-3
