Mr. Saurabh Kumar Pandey, learned counsel for the applicant. 2. Mr. Pankaj Joshi, learned A.G.A. for the State. 3. Present applicant-Sanjay Paswan is praying for regular bail in relation to FIR dated 13.11.2024 registered as FIR No. 0566 of 2024 at P.S. Rudrapur District Udham Singh Nagar wherein the applicant has been implicated for the offence punishable under Section 109 of BNS 2023 read with Section 3 and 25 of the Arms Act. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and has no previous criminal history. He further submits that location and the presence of the accused as shown in the site plan does not support the prosecution case, if comparing with the statement of the injured witness. Apart from this, he submits that charge sheet has already been filed and, therefore, there is no need of the custodial interrogation of the applicant. 5. Learned A.G.A. for the State has not disputed this fact that the applicant has no previous criminal history and the charge sheet has already been filed therefore there is no need of custodial interrogation. 6. Having heard the arguments of the learned counsel for the parties, this Court is of the view that since the charge sheet has already been filed and there is no need of custodial interrogation, and 2025:UHC:2202 furthermore the applicant has no previous criminal history, this Court is of the view that the applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the applicant Sanjay Paswan be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
