Sec. 2, 154, 155, 156, 160, 161, 164 and 172 and within the time specified under the Criminal Procedure Code in respect of offences pursuant to the FIR No.122 of 2019 dt.11-04-2019 on the file of the 3rd Respondent herein, as illegal, unconstitutional, violative of Criminal Procedure Code 1973, Indian Penal Code 1860 and also Art. 19, 21 of the Constitution of India and consequently direct the Respondent No.3 to follow the Code of Criminal Procedure 1973 and conclude the investigation in respect of FIR No. 122/2019 dt.11-04- 2019 for offences u/sec. 147, 148, 188, 450, 307, read with 149 IPC 3(1) (r), 3(1) (s) SC ST POA Act., as per Criminal Procedure Code 1973 at the earliest as per the said procedure code IA NO: 1 OF 2019 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased issue a direction directing the 3rd Respondent to conclude the investigation in pursuant to the FIR No. 122/2019 dt.11-04-2019 as per Criminal Procedure Code, forthwith in the interest of Justice. Learned Additional Government Pleader on written instructions would submit that the police file a case vide Crime No.122 of 2019 on the file of the Tadipatri Rural, UPS, Police Station and after due investigation referred the case as false vide C.No.8100/C2/DCRB-ATP/2-22 dated 27.10.2022 of the Superintendent of Police, Anantapuramu and filed the referred charge sheet on 28.10.2022 before the learned VIII Additional District & Sessions Judge-cum-Special Court for Trial of Cases under SC/ST (POA) Act, Anantapuramu. 3. In that view of the matter, the petitioner is at liberty to approach the Special Court, for filing objections on the final report, in accordance with the law. 4 4. With the above observation, without going into the merits of the case, this Writ Petition is closed at the stage of admission itself. No order as to costs.
