Neutral Citation No. - 2025:AHC-LKO:201-DB Court No. - 2 Case :- WRIT - C No. - 11029 of 2024 Petitioner :- Rajesh Kumar Tiwari Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Revenue Lko And 4 Others Counsel for Petitioner :- Anil Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Brij Raj Singh,J. Heard. The petitioner claims to have a judgment dated 22.08.2024 under Section 144 of the U.P. Revenue Code, 2006 in his favour and alleges unnecessary interference by the private opposite parties in the petitioner's holding, however on being asked, the petitioner's counsel informs that an appeal has been preferred against the said judgment. Learned Standing counsel says that at present, the village is under consolidation operations and if it so, then the entire proceedings under Section 144 of the U.P. Revenue Code, 2006 would stand abated. We do not wish to go into this issue as writ proceedings are not appropriate remedy in such cases where the dispute is between the private parties especially as petitioner's counsel could not point out any law/ provision under which respondent No.2 to 4 will restrain the respondent No.5 from disturbing the possession of the petitioner in respect of the land in question. The present petition is disposed of in the aforesaid terms with liberty that the petitioner may avail other remedies as may be permissible under law. (Brij Raj Singh,J.) (Rajan Roy,J.)
