Of Revenue Lko And 13 Others Counsel for Petitioner :- Rama Niwas Pathak,Dharmendra Kumar Pandey Counsel for Respondent :- C.S.C. Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioners. Notice on behalf of the respondents No.1 to 3 has been accepted by the office of the Chief Standing Counsel. By means of the instant petition, the petitioners seek disposal of the application purportedly filed under Regulation 460 of the U.P. Revenue Court Manual to give effect to the judgment and order passed in proceedings under Section 116 of the U.P. Revenue Code, 2006. Shri Yogesh Awati, learned standing counsel, on the basis of the written instructions, has submitted that the order of which the execution/implementation is being sought, was assailed by filing an appeal which is engaging the attention of the Commissioner, Ayodhya Division, Ayodhya wherein by means of the order dated 13.11.2024, the operation of the order passed by the trial Court has been stayed. Considering the aforesaid facts and circumstances as well as the pendency of the appeal wherein the order of which implementation has been sought, has been stayed, thus, this Court finds that there is no way that any order for expedition can be passed at this stage. Accordingly, the petition is dismissed. However, in case if the appeal is decided and the order is sustained, thereafter, the petitioners may pursue their remedy of seeking execution. With the aforesaid, the petition is dismissed. Order Date :- 3.1.2025 Rakesh/- Digitally signed by :- RAKESH PRAJAPAT High Court of Judicature at Allahabad, Lucknow Bench
