Neutral Citation No. - 2025:AHC-LKO:88-DB Court No. - 2 Case :- WRIT - C No. - 10993 of 2024 Petitioner :- Vijay Kumar Diwedi And Another Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Revenue Lko. And 4 Others Counsel for Petitioner :- Brijesh Kumar Pandey,Atul Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Brij Raj Singh,J. Heard learned counsel for the petitioners and learned Additional Chief Standing Counsel for the State. Proceedings under Section 67 of the U.P. Revenue Code, 2006 are already pending against the petitioners. The grievance is that the demarcation is not being undertaken properly. If it is so, then, the remedy lies elsewhere and not under Article 226 of the Constitution of India, as, the proceedings are still pending. If the petitioners are tenure holders they can take recourse to proceeding under Section 24 of the U.P. Revenue Code, 2006, if it is maintainable or seek such other remedies as may be permissible in law. The writ petition is absolutely ill advised. The writ petition is disposed of with liberty aforesaid as far as it may permissible in law. . (Brij Raj Singh,J.) (Rajan Roy,J.) Order Date :- 2.1.2025 R.K.P.
