Neutral Citation No. - 2025:AHC-LKO:8700 Court No. - 21 Case :- CONTEMPT APPLICATION (CIVIL) No. - 4734 of 2024 Applicant :- M/S Amar Nath Rice Mill Thru. Its Proprietor Amar Nath Agrawal And Another Opposite Party :- Sri Ravi Ranjan, M.D. State Agro Industrial Corporation Ltd., Lko. And 3 Others Counsel for Applicant :- Rajeiu Kumar Tripathi Hon'ble Manjive Shukla,J.
1. Compliance affidavit filed by Opposite Party No.1 is taken on record.
2. Heard Sri Rajeiu Kumar Tripathi, learned counsel appearing for the applicants and Sri Rajeev Kumar Sinha, learned counsel appearing for Opposite Party No.1.
3. Sri Rajeev Kumar Sinha, learned counsel appearing for Opposite Party No.1 has submitted that though the recovery proceedings had been stayed by this Court's order dated 3.9.2015 passed in F.A.F.O. No.734 of 2015 but due to inadvertent mistake the recovery citation was issued on 31.8.2024, which later on had been withdrawn.
4. Sri Rajeiu Kumar Tripathi, learned counsel appearing for the applicants has submitted that earlier also, in spite of the order passed by this Court the recovery proceedings were initiated and later on, after filing of the contempt petition the said recovery citation was withdrawn. Now again the same thing has been repeated. Learned counsel appearing for the applicants further submits that Opposite Party No.1 may be warned not to repeat the same thing in future.
5. I have considered the submissions advanced by the learned counsels appearing for the parties.
6. Since the recovery citation dated 31.8.2024 had already been withdrawn, there is no occasion for this Court to continue these contempt proceedings against Opposite Party No.1.
7. Accordingly, this contempt application is dismissed.
8. However, it is provided that in future Opposite Party No.1 shall remain cautious and will not repeat the same thing which
may constitute contempt of this Court. Order Date :- 11.2.2025 Salim Digitally signed by :- SALIM PRAVEJ High Court of Judicature at Allahabad, Lucknow Bench
