Neutral Citation No. - 2025:AHC-LKO:2050 Court No. - 14 Case :- HABEAS CORPUS WRIT PETITION No. - 376 of 2024 Petitioner :- Smt. Shalini Thru. Her Husband Sandip Kumar Respondent :- State Of U.P. Thru. Addl. Chief Secy. Home Lko. And 3 Others Counsel for Petitioner :- Durgesh Kumar Singh Counsel for Respondent :- G.A. Hon'ble Mohd. Faiz Alam Khan,J. 1. No one is present for the petitioner when this case is taken up for hearing. 2. Learned AGA for the State produced the instructions submitted by the Police Station Auras, District Unnao enclosed with an application given by the alleged detenue wherein she has admitted that she has solemnized marriage with the petitioner, however, now without being compelled by any one she is living with her parents with her free wish and will and is not willing to reside any more with the petitioner. 3. The report so submitted by the Police Station Auras, District Unnao is taken on record. 4. Since no one is present for the petitioner nor any adjournment prayer has already been made and the alleged detenue has admitted her marriage with the petitioner but in specific terms stated to be living with her parents with her free wish and will, which suggests that she has not been illegally detained, thus the petition appears to have lost its efficacy and is dismissed, as such.
