Neutral Citation No. - 2025:AHC-LKO:4554-DB Court No. - 1 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 1093 of 2024 Petitioner :- Ajay Singh Rana Respondent :- State Of U.P. Thru. Secy. Basic Edu. Lko And 5 Others Counsel for Petitioner :- Rajan Singh Counsel for Respondent :- C.S.C.,Kumar Ayush Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J. 1. Case called out. None present for the petitioner. 2. The writ petition has been instituted in public interest to restrain the opposite party nos. 5 and 6 to run the Intermediate College from class 1 to class 12 without obtaining recognition as required under the statute. 3. Sri Kumar Ayush, learned counsel appearing for the opposite party no. 4 has filed an affidavit wherein it is stated that the opposite party nos. 5 and 6 have a recognition for running the institution from class 1 to 8. 4. It is further submitted that on coming to know about the complaint as it has been averred in the present writ petition, an enquiry committee was constituted which undertook necessary exercise and it was found that no education whatsoever was imparted beyond the standard of class 8 in the institution in question. 5. Once it is clear that the opposite party nos. 5 and 6 are running educational institution after obtaining due permission from the authorities concerned up to class 8, the interference in the writ petion filed in public interest for the relief does not seem to be warranted, however we make it clear that the functioning of the educational institutional in question run as per the norms and law by itself being a public duty may not be interrupted on any frivolous ground. 6. The writ petition is accordingly dismissed. (Subhash Vidyarthi, J.) (Attau Rahman Masoodi, J.)
