3. On 07.11.2025 the applicant was granted interim bail on the ground that there is a matrimonial dispute in between the appellant and his wife complainant and Rs. 15 Lakhs was fixed towards the permanent alimony out of which Rs. 7.50 Lakhs were paid earlier but subsequently despite undertaking the remaining amount of 7.50 lakhs were not paid. While granting bail learned counsel for the applicant apprise to this Court that in fact the remaining Rs. 7.50 lakhs as per their written agreement is to be paid after obtaining divorce by way of mutual consent. Now the applicant moved urgency application enclosing the decree of divorce which was granted by way of mutual consent and he also submits that the remaining amount Rs. 7.50 lakhs have also been encashed by the respondent/complainant.
4. In such view of the matter, since now, the divorce decree is passed by way of mutual consent and the remaining balance of amount of Rs. 7.50 lakhs towards the permanent alimony has been encashed by the respondent wife, this Court is of the view that the interim bail
granted on 07.11.2025 has to be made absolute.
5. On the other side, Mr. Himanshu Sain, learned Brief Holder for the State have not disputed this fact that since the divorce decree has been passed by way of mutual consent, therefore, the interim bail granted to the applicant be made absolute.
6. In such view of the matter, the interim bail granted on 07.11.2025 is made absolute.
7. The present bail application is
disposed of.
