PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Petition, u/Sec.480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A2, seeking bail, in Crime No. 144/2025 of Bhimunipatnam Police Station, Visakhapatnam Commissionerate. 2. A case has been registered against the petitioner and another for the offence punishable u/Sec.108 r/w 3(5) of B.N.S. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondent/State. 2 4. Case of the prosecution, in brief, is that, this is a case of abetment of suicide with common intention that occurred on 21.3.2025 at 3:00 P.M at Gollalapalem, 2nd Ward, Bheemunipatnam. Ramana (hereinafter called as called as defacto complainant) is resident of Gollalapalem, Bheemunipatnam. The marriage in between the defacto complainant and his wife Rajeswari held at about 12 years back and out of their wedlock the deceased blessed with two children. On 20.3.2025 at about 8:00 pm to 8.30 pm, A1 made a phone call to his younger brother Peethala Madhu and threatened that her sister-in-law (deceased) used to make phone calls to her husband Suresh (A2) frequently talking with each other and also threatened her and that he (younger brother of the defacto complainant) informed the same to him (defacto complainant). On the day night A1 called one Thotamma, who used to live in the next door at the defacto complainant's house and asked her to give phone call to the deceased, but he did not know the conversation in between them. 21.3.2025, the deceased did not go to her duty, but the defacto complainant went to duty at morning hours and returned back for lunch, at that time he noticed that his wife was talking with someone over phone, for which she told that A1 made a phone call to her and she was talking and made false allegations that she was talking with A2. complainant went to duty. Later, he received a phone call stating that the deceased committed suicide by hanging. The deceased committed suicide due to unbearable humiliation, insult and threatened made by A1 and her One Peethala Venkata same On Thereafter, the defacto 3 husband, the deceased depreked and she committed suicide. Basing on the report of defacto complainant, the present crime was registered and the petitioner was arrested on 22.3.2025. Heard. Perused the record. Learned counsel for the petitioner contends that A1 is the wife of the petitioner/A2 and she was released on bail as per the orders passed in Crl.M.P.No.938/2025 dated 09.4.2025 by the learned Sessions Judge, Mahila Court, Visakhapatnam and prays to allow the criminal petition and enlarge the petitioner on bail. Learned Assistant Public Prosecutor opposes to grant bail on the ground that investigation is not completed and some more witnesses are to be examined and have to record their statements. According to the case of the prosecution, A1 made phone calls to the deceased and her brother and warned them not to talk with her husband. Learned counsel for the petitioner submits that in the said facts of the case, it is difficult to come to a conclusion that it is a case of abetment to commit 5. 6. 7. 8. suicide. Without going into the facts of the case, as A1 said to be released on bail, this Court finds that the facts of the case of the present petitioner is on the same lines as that of A1. The petitioner has been in judicial custody from 22.3.2025, as such this Court finds that most of the investigation pertaining to the role played by the petitioner in the commission of the 9. I % 4 offence might be completed. In view of the same, this Court is inclined to allow the criminal petition. In the result, the Criminal Petition is allowed with the following 10. conditions: (i) The petitioner/A2 herein shall be released on his executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the learned XV Additional Judicial First Class Magistrate, Bheemunipatnam; (ii) On release, the petitioner shall appear before the Station House Officer concerned as and when his presence is required; (iii) the petitioner shall not tamper with the evidence and hamper the investigation and shall cooperate for investigation.
