The instant application has been preferred by the applicant under Section 24 C.P.C. seeking transfer of Case No.2116 of 2019, which has been filed under Section 125 Cr.P.C. and it is said to be pending before the Principal Judge, Family Court, Sitapur to the appropriate court in District Lucknow. A specific query was put to the learned counsel for the petitioner as to how the proceedings under the Code of Criminal Procedure can be transferred under Section 24 C.P.C. Learned counsel for the petitioner after attempting to make some submissions, submits that he may be permitted to withdraw the petition with liberty to take recourse to the appropriate provisions for transfer of the said case, as may be permission under the law.
