ORAL ORDER Accused in SC.No.4/2025 pending before the Court of Principal District and Sessions Judge, Bengaluru Rural District, Bengaluru, arising out of Crime No.271/2024 registered by Nelamangala Town Police Station, Bengaluru District, for offences punishable under Sections 109, 351(2), 352 and 85 of BNS, 2023 is before this Court under Section 483 of BNSS, 2023 seeking regular bail.
2. Heard the learned Counsel for the parties.
3. FIR in Crime No.271/2024 was registered by Nelamangala Town Police Station, Bengaluru District, for the aforesaid offences against the petitioner herein, based on the first information dated 22.11.2024 received Anusha, who is the wife of petitioner.

4. During the course of investigation, petitioner was arrested on
23.11.2024. After completion of investigation, charge sheet has been filed against him for the aforesaid offences. Bail application filed by the petitioner before the Jurisdictional Sessions Court in Crl.Misc.No.90/2025 was rejected on 29th January, 2025. Therefore, petitioner is before this Court.

Learned Counsel for the petitioner having reiterated the grounds urged in this petition has prayed to allow this petition.
6. Per contra, learned HCGP has opposed the petition.
7. Perusal of the material on record would go to show that the first informant who is the alleged victim in the present case has not suffered any injuries in the incident in question. Petitioner who has no other criminal antecedents is in custody from 23.11.2024. Investigation of the case is completed and charge sheet has been filed.

It appears that incident in question had taken place after the husband and wife had fought against each other on petty issues. Under the circumstances, I am of the view that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following:-
ORDER
The petition is allowed. The petitioner is directed to be enlarged on bail in SC.No.4/2025 pending before the Court of Principal District and Sessions Judge, Bengaluru Rural District, Bengaluru, arising out of Crime No.271/2024 registered by Nelamangala Town Police Station, Bengaluru District, for offences punishable under Sections 109, 351(2), 352 and 85 of BNS, 2023, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with one surety for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future;
