Neutral Citation No. - 2025:AHC-LKO:49164 Court No. - 12 Case :- CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 210 of 2024 Applicant :- Islamuddin Opposite Party :- State Of U.P. Thru. Prin. Secy. Home, Lucknow And Another Counsel for Applicant :- Anand Kumar Sharma,Aakash Rai,Vaibhav Sharma Counsel for Opposite Party :- G.A.,Rajesh Kumar Gupta Hon'ble Karunesh Singh Pawar,J. List revised. None appears on behalf of the applicant. Learned A.G.A. for the State is present. The present application under Section 438 Cr.P.C./482 B.N.S.S. has been filed seeking anticipatory bail in FIR/Case Crime No. 197 of 2024, under Sections 69, 60(b), 316(2) of B.N.S., P.S. Rahimabad, District Lucknow. In the prosecution case, it is alleged that the applicant on the pretext of marriage has been indulging in sexual intercourse with the victim for about two years without any intent to marry her. It is alleged that owing to the promise of marriage, an amount of Rs. 10 lakhs has been given to he applicant by her family members, out of which some amount has been given in the account of the applicant online and some amount has been given to him by selling jewellery. But later on, the applicant has refused to return the said money and marry her as well. Learned A.G.A. has opposed the anticipatory bail application. Perused the record. Considering the gravity of the offence, complicity of the applicant and the fact that the victim has corroborated the prosecution story in her statements under Sections 180 and 183 BNSS, it does not appear to be a case of false implication. In view of the above, no ground for grant of anticipatory bail is made out. Accordingly, the anticipatory bail application is rejected.
