The petitioner claims that she is entitled to the benefit of financial upgradation/selection grade and the Ist, IInd and IIInd Assured Career Progression, etc. She has made a representation in this regard but to no avail. Learned Standing Counsel for the respondents No.1 to 4- State and Shri Saurabh Tiwari, learned counsel for the respondent Nos.5 and 6 submit that the matter requires determination of facts by the competent authority as per law in the first instance. However, they fairly contend that service benefit/claim is liable to be decided by the competent authority in a reasonable time frame. In light of the aforesaid submissions and without going into the merits of the case, the respondent No.5-Executive Officer, Nagar Panchayat Sasni, District-Hathras / competent authority shall decide the representation of the petitioner regarding benefit of financial upgradation/selection grade and the Ist, IInd and IIInd Assured Career Progression, etc. as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of.
