01.09.2025 CM APPL. 54522/2025
1. There is already a grant of probate in favour of petitioner herein.
2. Petitioner has already reportedly deposited the court fee and the mere request in the present petition is a direction to learned Probate Court not to insist for Administration-cum-surety bond for the equivalent amount.
3. In this regard, the petitioner has strongly relied upon Ravi Mohan Kaul v. State, 2019 SCC OnLine Del 12093 and Arvind Nanda v. State, 2020 SCC OnLIne Del 2922.
4. It, however, seems that no such request has been made by the petitioner before learned Probate Court and it will, therefore, be appropriate that the petitioner makes such request before learned Probate Court.
