02/ Dated 01.07.2025
Heard Mr. Gautam Kumar, learned counsel for the appellant and Mrs. Vandana Bharti, learned A.P.P. on behalf of the State. This appeal is directed against the order dated 15.05.2025, passed by the learned Sessions Judge, Sahibganj in connection with A.B.P No. 226 of 2025, arising out of Mirzachouki P.S. Case. No. 80 of 2024, whereby and whereunder, the prayer for anticipatory bail of the appellant has been rejected.
It has been submitted that the appellant had earlier moved for grant of anticipatory bail in Criminal Appeal (D.B.) No. 174 of 2025 and the same was withdrawn by an order dated 09.04.2025 on account of the submission made by the learned counsel for the appellant that the appellant is ready to surrender before the learned Trial Court. Learned counsel for the appellant has further submitted that after the withdrawal of the earlier anticipatory bail application, some of the co-accused have been granted bail by this Court in Cr. Appeal (D.B.) No. 129 of 2025, Cr. Appeal (D.B.) No. 138 of 2025 and Cr. Appeal (D.B.) No. 315 of 2025, which has prompted the appellant to renew his prayer for anticipatory bail. Learned A.P.P has opposed the prayer for anticipatory bail of the appellant.
On specific submission advanced by the learned counsel for the appellant that the appellant was ready to surrender before the learned Trial Court, his earlier application for grant of anticipatory bail was permitted to be withdrawn.
-2- Despite such withdrawal the appellant has once again renewed his prayer for grant of anticipatory bail. We, in view of such fact, are not inclined to reconsider such prayer and hence, the present appeal stands dismissed.
