Mr. Aditya Singh, learned counsel for the applicant. 2. Mr. Siddharth Bisht, learned A.G.A. and Mr. Himanshu Sain, learned Brief Holder for the State. 3. Present applicant-Sarbjeet Singh @ Chabba, S/o Kulwinder Singh is praying for regular bail in relation to FIR dated 03.01.2025, registered as FIR No. 007 of 2025 at P.S. Bazpur District Udham Singh Nagar wherein the present applicant has been implicated for the offences punishable under Sections 109(1) and 351 (3) of BNS 2023. 4. Brief facts, of the case, are that the applicant is the real brother of Ms. Mandeep Kaur who married with one Navjot Singh on 09.03.2023. An FIR was lodged by one Sarvjeet Kaur, mother of Navjot Singh, who is the husband of the sister of the present applicant. As per the FIR, the applicant was not happy with this marriage and there was a threat to Mandeep Kaur and her husband regarding which the protection was also sought from the police, and, thereafter they approached this Court seeking protection and thereafter protection was given. Thereafter, the incident was happened on 12.01.2025 by which the applicant by way of rash and negligent driving hit the motorcycle of Navjot Singh. 5. The allegation was that the said attempt was done with an intention to kill Navjot Singh. Consequently, after lodging the FIR, the applicant was 2025:UHC:2256 arrested on 08.01.2025 and after investigation charge sheet has been filed. 6. On 25.03.2025, the sister of the applicant, namely, Ms. Mandeep Kaur and her husband Navjot Singh joined the proceedings through V.C. Both of them informed this Court that there is a threat perception from the side of the present applicant and the father also. 7. Mr. Aditya Singh, learned counsel who appears for the applicant submits that the present applicant and his brother Harpreet Singh and father Kulwinder Singh have no such intention and they all are agreed to accept their marriage happily. On this assurance matter was posted for today. 8. Today, again Ms. Mandeep Kaur and her husband Navjot Singh joined the proceeding through V.C. and apprise this Court that father of Ms. Mandeep Kaur as well as her younger brother Harpreet Singh and mother visited their house and all of them had lunch together and they happily accept their marriage. This Court further interact with the younger brother Manpreet Singh, Ms. Mandeep Kaur and Navjot Singh, who appears through V.C. and they all appears to be happy and Ms. Mandeep Kaur and her husband submits that now there is no threat perception. 9. It appears now the parties who are, in fact, close relatives have resolved their disputes amicably. 10. Mr. Bisht, learned A.G.A. submits that since, prima facie, it appears that the parties have resolved their dispute, therefore, there is no purpose to keep the present applicant in jail, particularly when the charge sheet has been filed. He fairly submits that if the parties have settled their dispute they can further go for compounding of the offences. 11. The suggestion, as given by the learned A.G.A. is really appreciable, 2025:UHC:2256 particularly when the parties have settled their dispute and the victims of the FIR also submits that now at this juncture there is no threat perception. 12. After hearing the arguments of the learned counsel for the parties and further taking into consideration the fact that since now the parties have settled their disputes amicably and today both the victim Ms. Mandeep Kaur and her husband Navjot Singh joined the proceedings through V.C. and the younger brother Manpreet Singh who is also present in Court on interaction submits that he and his all family members happily accept their marriage, this Court is of the view that the present applicant deserves for bail. 13. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 14. Let the applicant Sarbjeet Singh @ Chabba be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
