It has been averred in the application that the impugned judgment was passed on 01.10.2024 by the Ld. District Judge, Mandi, District Mandi,H.P. The certified copy of the impugned judgment was applied on 04.12.2024 and the same was delivered on 19.12.2024. However, due to inadvertence and oversight , the certified copy was misplaced and could not be traced despite best efforts. Further, it has been averred that the misplacement of the certified copy was neither intentional nor willful and the same has occurred due to unavoidable circumstances, which were beyond the control of the applicant. Keeping in view the averments as made in the application, which is duly supported by an affidavit and in view of the submissions as made by the learned counsel for the applicant/appellant, the application is allowed and the delay of 275 days in filing of appeal is condoned.
