Neutral Citation No. - 2025:AHC-LKO:2938 Court No. - 8 Case :- MATTERS UNDER ARTICLE 227 No. - 5856 of 2024 Petitioner :- Sundar Lal Respondent :- Addl. Commissioner (Judicial), First Lucknow Divisiow, Lucknow And 2 Others Counsel for Petitioner :- Salik Ram Yadav Counsel for Respondent :- C.S.C. Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner as well as the learned Chief Standing Counsel who has filed a copy of the written instructions under the signatures of Additional Commissioner (Judicial)- II, Lucknow dated 15th January, 2025 which is taken on record. As per the written instructions, it is pointed out by the learned Standing Counsel that as per the averments made by the petitioner, it is stated by him that he had filed Appeal No. 2626 of 2023 wherein an interim order was passed and despite an application for extension of the interim order was moved by the petitioner, the same has not been extended. It is in this context that the learned Standing Counsel submits that first and foremost the interim order which was granted was in a revision bearing No. C-202310000000316 under Section 210 of the U.P. Revenue Code, 2006 and in the said revision, there is no application for extension of the interim order, however, as far as the appeal bearing No. 2626 of 2023 wherein the petitioner has alleged that he has received an interim order and has not been extended is not correct. The learned counsel for the petitioner could not dispute the fact nor the material available on record could indicate that there was any interim order passed in the Appeal no. 2626 of 2023 as alleged by him. For the aforesaid reasons, the prayer as claimed by the learned counsel for the petitioner cannot be granted, accordingly, the present petition is dismissed leaving it open for the petitioner to take recourse as may be available to him in law.
