Mr. Vikas Kumar Guglani, learned counsel for the applicant. 2. Mr. G.S. Sandhu, learned Additional Advocate General with Mr. Himanshu Sain, learned Brief Holder for the State. 3. The present applicant Irshad @ Pintu S/o Sahid Hussain is praying for bail in reference to First Information Report dated 18.12.2024 bearing FIR No. 0608 of 2024 P.S. Jaspur, District Udham Singh Nagar, wherein, the present applicant along with one Arman Khan have been implicated for the offences punishable under Section 8/21 r/w Section 60 of NDPS Act. 4. The First Bail Application was rejected on 19.02.2025 and now the second bail application has been filed on the ground that the applicant already suffered long incarceration since he is in jail since 19.12.2024. He further submits that the charge-sheet has already been filed and earlier in all criminal cases applicant is already bailed out. 5. On the other side, learned State counsel submits that the applicant is the habitual offender and in fact since 2010 he is indulged in criminal activities though granted bail in all previous cases. 6. After hearing the arguments of learned counsel for the parties and taking into consideration that the present applicant is languishing in jail since 19.12.2024 and the charge- sheet has already been filed, therefore, taking into consideration that the applicant already suffered long incarceration, this court is of the view that the applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case the second bail application is allowed. 8. Let the applicant ‘Irshad @ Pintu’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the 2025:UHC:11359 satisfaction of the court concerned.
