The instant application has been filed seeking following main relief:- "WHEREFORE, it is humbly prayed that this Hon'ble Court may kindly be pleased to quash the proceedings initiated by charge-sheet dated 28.10.2022 filed by the investigating officer in Case Crime No. 440/2022, Under Section 419, 420, 504 I.P.C., Police Station Mahmudabad, district Sitapur pending before Learned Judicial Magistrate IInd, Sitapur, vide Case No. 3543/2022 In'Re; "State Versus Nandani Vishwakarma" on the basis of the compromise dated 04.09.2024 annexed as Annexure No. 4 to this petition, in the interest of justice." On account of some formal defects crept in this application, learned counsel for the applicant prays for withdrawal of this application with liberty to the applicant to file a fresh application with proper pleadings and documents in support thereof. The aforesaid has not been opposed. In view of the above, the instant application is dismissed as withdrawn with liberty, as prayed for. Office is directed to return certified/original copies of the documents, if any, annexed with this application to the learned counsel for the applicant as per relevant Rules in this regard.
