By the present writ petition, the petitioner, who is working as Staff Nurse in Medical College, Ambikapur, seeking a limited direction towards the respondent No.3 to decide the objection raised by the petitioner to the gradation list as on dated 01/04/2024 published on 28/01/2025. 2. Learned counsel for the petitioner submits that though the gradation list as on 01/04/2025 has been published by the respondent No.3 on 28/01/2025 about the seniority of the Staff Nurse in the Directorate of Medical Education, the name of the petitioner has been placed at Sr. No.776 by considering her date of joining on transfer, whereas the respondents authority has to consider the first date of appointment for seniority. The petitioner has raised objection to the said wrong placement of her name in the seniority list of Staff Nurse vide Annexure P-11 before the respondent Nos.2 & 3 on 06/02/2025, but till date, the grievance of the petitioner has not been redressed. 3. Learned counsel for the respondents submits that if the representation is still pending before the respondent Nos.2 & 3, 3 the same shall be considered in accordance with law within stipulated period. 4. I have heard learned counsel for the parties, perused the pleadings and documents. 5. It appears that the petitioner’s date of initial appointment is 10/04/2008 and as per the petitioner, the date of appointment has not been taken into consideration while placing the petitioner in the gradation list dated 01/04/2025 published on 28/01/2025. The petitioner has raised the grievance before the respondent Nos.2 & 3 vide Annexure P-11 on 06/02/2025, hence, the writ petition is disposed of with a direction to the respondent No.3 to consider and decide the representation Annexure P-11 dated 06/02/2025 within a period of 45 days from the date of receipt of copy of this order in accordance with law and on its own merits. 6. With the aforesaid observation and direction, the writ petition is disposed of. The petitioner is at liberty to apprise the respondent No.3 about the order of this Court.
