Present petition has been filed with a prayer to direct the respondents no. 2 and 3 to arrest the respondent no. 4 to 7 and conduct the fair and proper investigation into the matter and submit the police report as soon as possible in Case Crime No. 0293 of 2024, under Sections 351(3), 109 BNS, P.S. Nagphani, District Moradabad. 3. The first information report is dated 28.12.2024 and present petition has been filed on 21.1.2024, therefore, apparently the same has been filed with undue haste. 4. At this stage, learned counsel for the petitioner prays that the petitioner may be permitted to withdraw the present petition. 5. Prayer aforesaid is allowed. 6. Present petition is accordingly dismissed as withdrawn with liberty to the petitioner to avail the remedy under Section 175(3) of BNSS, if the need so arises.
