(2) Petitioner has challenged two orders dated 15.3.2022 and 14.3.2022, passed by Senior Foremen, Divisional Workshop, Dehradun and Divisional Manager (Technical), Dehradun respectively. By the first order, a sum of ₹3,42,672/- was ordered to be recovered from the amount payable as ACP/ Gratuity to the petitioner. By the second order dated 14.3.2022, ₹2,64,695/- was ordered to be recovered from the amount payable as ACP and further a sum of ₹77,977/- was ordered to be recovered from the amount payable as gratuity to the petitioner. (3) It is not in dispute that petitioner retired from the post of Assistant Mechanic on 28.2.2019. Thus the recovery orders were passed against the petitioner after his retirement. (4) Learned Counsel for the petitioner submits that identical issue was decided by Division Bench of this Court in Special Appeal No. 245 of 2022 and other connected special appeals, therefore this writ petition also deserves to be decided in terms of the judgment dated 4.4.2024, rendered in Special Appeal No. 245 of 2022. (5) Mr. Lalit Samant, learned Counsel for the respondents, concedes that the 2025:UHC:10251 issue involved in the present case is identical to the one decided in Special Appeal No. 245 of 2011. (6) In view of consensus between the parties, this writ petition is decided in terms of the judgment dated 4.4.2024, rendered in Special Appeal No. 245 of 2022.
