Debendra, learned Deputy AG assisted by Ms. Sharmila, learned counsel appearing for the respondents. It has been submitted by both the counsel appearing for the parties that the present writ petition can be disposed of in terms of the direction given by a Division Bench of this court in its order dated 16-12-2024 passed in WP(C) No. 534 of 2023. The operative portion of the said order is as under:- “Considering the fact that more than 2(two) years have been lapsed for filing up the said vacant posts of Executive Engineer in the respondent department and considering the 25(twenty five) posts are still vacant for filling the post of Executive Engineer in the respondent department and according to the respondents that 22 (twenty two) qualified Assistant Engineers are available for consideration for the post of aforesaid Executive Engineers. In the circumstances, we are of the view that the State Government is directed to consider and to take appropriate decision in the light of the Rural Engineering (RED) under RD & PR, Government of Manipur Executive Engineer (Planning)/ Surveyor of Works (Civil); Executive Engineer (Civil); SW(Executive Engineer-Plg/Admn.) and SW/Executive Engineer Recruitment Rules 2022 as early as possible within a period of 3(three) months from the date of receipt of a copy of this order and we make it clear that we are not expressing any positive direction for the State Government to consider for granting relaxation. Needless to say that it is for the Manipur Public Service Commission (MPSC) to take appropriate decision for considering the exemption to these qualified Assistant Engineers for promotion to the post of Executive Engineers.” In the present writ petition, the only relief sought for by the petitioners is for issuing a direction to the respondents to consider the case of the petitioners for promotion to the post of Executive Engineers (Civil) in the Rural Engineering Department, Manipur, in terms of the relevant recruitment rules published in the Notification dated 28-09-2022 by strictly following the Office Memorandum dated 15-05-2014 by the Government. Mr. H. Debendra, learned Deputy AG fairly submitted that the relief sought for by the present petitioners in the present writ petition are squarely covered by the direction given earlier by the Division Bench of this court, which has been quoted hereinabove and as such, the present writ petition can be disposed of in terms of the direction given by the Division Bench. In view of the submission made above and on perusal of the record, this court is of the considered view that interests of justice will be met if the present writ petition is disposed of with the following direction:- (i) The respondents are hereby directed to consider the case of the present petitioners along with other eligible candidates strictly in terms of the direction given by the Division Bench in its order dated 16-12-2024 passed in WP(C) No. 534 of 202, which has been quoted hereinabove. With the aforesaid direction, the present writ petition is disposed of.
