GP FOR EDUCATION (AP) The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a writ of Mandamus, declaring the action of 2nd Respondent in keeping the Petitioner under suspension vide proceedings No. ANU/NT Esst/S.I./Time Scale NMR/ Suspension/2017 dated 30.12.2017 with retrospective effect from 05.12.2017 on conduct and disciplinary rules of the University and CCA rules 1991 as arbitrary and violation of Articles 14 and 21 of Constitution of India and Sec 9 - A of Industrial Disputes Act, 1947 and consequently direct the 2nd Respondent to reinstate the Petitioner by cancelling the said proceedings.” 2 2. When the matter is taken up for hearing, Sri G.Rama Chandra Rao, learned Government Pleader for Higher Education brought to the notice of the Court that the Petitioner is reinstated into service and he is a temporary NMR. It is further submitted that, the Petitioner was suspended from service when he was in judicial custody on 05.12.2017 with regard to a criminal case in Crime No.339 of 2017 on the file of Pedakakani Police Station, Guntur for the offences under Sections 324 and 506 read with 34 IPC and Section 3 (1) (r) (s) of SCs & STs (PoA) Act. 3. Sri K.Ramachandra, learned counsel for the Petitioner would submit that Court may pass appropriate orders. 4. In the light of the submissions made, since the Petitioner was reinstated into service, no further orders are required in this matter. 5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
