Deepa Dwivedi) instituted by opposite party no.2 under Section 9 of the Hindu Marriage Act from Family Court Jalaun at Orai to District Bahraich. In view of fact that proceedings are pending at Allahabad in view of judgment rendered in the case of Smt. Shivika Upadhayay v. Pushpendra Trivedi, Transfer Application (Civil) No.674 of 2024, this application is not maintainable before this Court at Lucknow. Considering the aforesaid law, learned counsel for applicant on the basis of instructions seeks to withdraw this application with liberty to file afresh at Allahabad. In view of such submissions made, application is dismissed as withdrawn granting liberty to file before this Court at Allahabad.
