The petitioners seek issuance of a writ, order of direction in the nature of mandamus commanding the opposite parties to provide the relief amount (Rahat Raashi) to the petitioners under the provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 and its rules 1995, in connection with the First Information Report No. 326 of 2023, under Sections 363,366 I.P.C. and charge sheet filed under Sections 363,366 & 376 of I.P.C., Section 3/4 of the POCSO Act and Section 3(2)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 lodged at Police Station Mariyaun, District Commissionerate Lucknow. Learned counsel for the petitioners submits that the petitioners have applied for providing relief amount under the provisions of SC/ST Act. He further submits that though the matter is pending since 2023 but no decision has been taken till date. In view thereof, the District Social Welfare Officer of District Commisionerate, Lucknow, opposite party no.3 is directed to take decision for providing relief amount under the provisions of SC/ST Act to the petitioners in accordance with law within a period of two months from the date a certified copy of this order along with a copy of the application is produced before him and communicate the same to the petitioners.
