16.04.2025 Heard Mr. U. Augusta, learned counsel appearing for the petitioner and Mr. Th. Vashum, learned GA appearing for the respondents. The present petition has been filed praying for directing the respondents to pay pension and other retiral benefit due payable to the petitioner within a stipulated period. The case of the petitioner is that he retired from service w.e.f 31.01.2024 on attaining the age of superannuation vide order dated 07.03.2024 issued by the Deputy Secretary (TA & Hills), Govt. of Manipur. It has been submitted by the learned counsel appearing for the petitioner that after his retirement from service, the authorities have not released the pensionary and other retiral benefits due payable to the petitioner till date and having being aggrieved, the petitioner approach this court by filing the present petition for redressing his grievances. Mr. Th. Vashum, learned GA appearing for the respondents submitted that as a criminal case is pending before the competent Criminal Court against the petitioner, the authorities have not release the pensionary and other retiral benefits of the petitioner. pension as provided under Rule 9(iv) read with Rule 69 of the CCS pension Rule, 1965. Mr. U. Augusta, learned counsel for the petitioner submitted that the present petition be disposed of by directing the respondents no. 1 & 3 to release the provisional pension and other retiral benefits due payable to the petitioner in terms of the provisions under Rule 9(iv) read with Rule 69 of the CCS pension Rule, 1965 within a stipulated period so as to mitigate the hardship of the petitioner.
Taking into consideration the submission advanced by the counsel of the parties and on perusal of the record, this Court is satisfied that the ends of justice will met if the following directions are issued:- (i) The respondents 1 & 3 are hereby directed to complete the process for payment of the provisional pension and other retiral benefits due payable to the petitioner in terms of the provisions under Rule 9(iv) read with Rule 69 of the CCS pension Rule, 1965 and to release the same within a period of 3(three) months from the date receipt of certified copy of this order. (ii) The petitioner is also directed to give full cooperation to the authorities at the time of preparation for payment of this provisional pension and other retiral benefits as and when he is required to do so. With the above directions, the present petition is disposed of. JUDGE
