This is second bail application. 3. This bail application has been filed by the applicant with a prayer to enlarge him on bail in Case Crime No. 515 of 2018, u/s 147, 148, 149, 302, 286 I.P.C., Police Station- Kandhai, District- Pratapgarh. 4. Learned counsel for the applicant submits that the applicant is in jail since 17.01.2019, but the trial has not been concluded till today and in near future, there is no possibility of conclusion of the trial. He further submits that till today, only four witnesses have been examined out of 21 witnesses, hence, the applicant is entitled for bail. 5. Learned A.G.A. vehemently opposes the prayer for bail and submits that the applicant is having criminal antecedents of 15 cases and most of these offenses are heinous in nature, hence, he is not entitled for bail. 6. Considering the submissions of learned counsel for the parties and going through the contents of the bail application as well as other relevant material including the statements of the witnesses, it is evident that the applicant is having criminal antecedents of 15 cases and in several offenses, the allegations against the applicant are for the offenses u/s 307, 302, 395 I.P.C. Therefore, the applicant is not entitled for bail. 7. In view of above, this bail application is rejected. 8. The trial Court is directed to conclude the trial of the case in question on day to day basis. 9. Office is also directed to communicate this order to the trial Court, forthwith.
