Applicant Jayveer Singh Rawat seeks anticipatory bail in Case Crime/FIR No.1/2025 punishable under Sections 79, 108 & 352 of Bharatiya Nyaya Sanhita, 2023, Police Station Kirti Nagar, District Tehri Garhwal. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, on 24.10.2024, the applicant threatened the wife of respondent no.3 and harassed her stating that he will circulate rumours about her character and resultantly, she hanged herself to death on the same day. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He further submits that the name of the applicant has been unnecessarily dragged into the FIR arising out of sudden altercation. The applicant has no criminal history. 5. On the other hand, learned State Counsel objects to the Anticipatory Bail Application. 6. Having considered, this Court is of the view that this is a case, in which the applicant may be granted anticipatory bail. The instant anticipatory bail application deserves to be allowed. 7. The anticipatory bail application is allowed. 8. In the event of his arrest, the applicant shall be enlarged on bail on his furnishing a personal bond with two sureties, each in the like amount, to the satisfaction of the Investigating Officer concerned. In addition to it, the applicant shall also comply with the following conditions:- (i) The applicant shall not approach any witness in any manner, whatsoever. (ii) The applicant shall not leave the country without prior permission of the court concerned. (iii) The applicant shall deposit his passport with the court concerned. The passports may only be returned by the order of the court concerned. In case the applicant does not have passport, he shall give an undertaking to that effect to the court concerned. (iv) The applicant shall also give an undertaking on (i) & (ii) above.
