1.PUBLIC PROSECUTOR The Court made the following Order: The Criminal Petition, under Section 482 of the BNSS, is filed behalf of the petitioner herein/A2 to grant anticipatory bail in with Crime No.92 of 2025 of Prohibition & Excise on connection Station, Rajamahendravaram South, East Godavari District, has been registered against the petitioner and A case another for the offence punishable under Sections 7-B read with 8 A and 8-B of the A.P. Prohibition (Amendment) Act, 2020.

Brief facts of the case are that, on 10.02.2025, the Prohibition and Excise Inspector, Rajamahendravaram South along with his staff and mediators rushed to coconut garden in Bangala
3. On thota in front of poultry farm road and found two persons, seeing the police party, they escaped from the spot. On verifying the said place, police found 120 liters of ID liquor and 200 liters of FJ wash. The contraband along with other material was seized under the cover of mediators report. y
I 2 Heard. Perused the record.
Learned counsel for the petitioner submits that basing on the confessional statement, the petitioner herein is arrayed as accused and no illicit liquor has been seized from the possession of petitioner herein, and no other material has been collected to connect the petitioner in commission of offence. Learned Assistant Public Prosecutor has also not disputed the correctness of the said submission of learned counsel for the petitioner. Learned Assistant Public Prosecutor vehemently opposed to grant anticipatory bail to the petitioner herein and submitted that the petitioner herein has no previous crime record. In view of the facts and circumstances of the case and considering the fact that no property was seized from the possession of the petitioner herein and most of the witnesses are shown to be official witnesses and granting of anticipatory bail to the petitioner would not cause hampering of investigation, this Court is inclined to grant anticipatory bail to the petitioner herein, on the following conditions, (i) The petitioner is directed to surrender before the Station House Officer concerned, within a period of two (2) weeks from the date of receipt of a copy of this order. On such surrender, the petitioner herein is ordered to be enlarged on bail on his executing a personal bond for Rs. 10,000/- (Rupees ten thousand only) with one surety for the like sum to the satisfaction of the Station House Officer concerned, (ii) On release, the petitioner shall appear before the Station House Officer, concerned, once in a fortnight, for a period of three (3) months.
