This anticipatory bail application under Sections 438 and 440 of the Cr.P.C. has been preferred by the petitioner is apprehending his arrest for the offences under Sections 18, 27(A), 28, 29 of NDPS Act and under Section 33 of Indian Forest Act. There is allegation that the petitioner is cultivating opium. Though his name transpired from the confessional statement of the other co-accused, but the fact remains that material was found that he was indulged in cultivation. Considering the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Lawalong P.S. Case No.63 of 2023, pending in the court of learned Additional District Judge-II, Chatra stands rejected. (ANANDA SEN, J.) R.S./
