Learned A.G.A. for the State Respondents has filed a short counter affidavit wherein a copy of the order passed by the Child Welfare Committee has been filed as annexure-01, which is taken on record, wherein it has been stated that the victim was lodged in Government Children Home at Prayagraj by the order of the Child Welfare Committee, however, now she has reached the age of majority, her statements under Sections 161 and 164 Cr.P.C. have been recorded. The Victim has also been found to be pregnant. On the basis of evidence recorded Section 376 and Section 5(J) and 2/6 of the POCSO Act has also been invoked. Since the victim has refused to go with her parents and wanted to go and live with her husband. She being major has been allowed and to go live with her husband.
