---- 06/18.08.2025 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Bengabad P.S. Case No.98 of 2024, for the alleged offences registered under Sections 316(2), 318(2), 351(3) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned C.J.M., Giridih.

Learned counsel appearing for the petitioners submits that the matter is arising out of an agreement of sale. He submits that the allegations are made that the land has not been transferred in favour of the informant and for that a suit has also been instituted by the informant being Original Suit No.140 of 2024 contained in Annexure-2. He further submits that the case is civil in nature,

however, criminal color has been provided.

Learned counsel appearing for the State opposes the prayer and submits that the allegations are made of not registering the land in favour of the informant.

Considering that the suit has already been instituted for not compliance of sale agreement and that was the correct course of action on behalf of the informant if the agreement was not being complied with and the criminal case has also been filed for the said action, I am inclined to provide anticipatory bail to the petitioners.
6. Accordingly, the petitioners, above named, are hereby
directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned C.J.M., Giridih in connection with Bengabad P.S. Case No.98 of 2024, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
