Nirdesh and others, arising out of case crime no.283 of 2018, under Sections 323, 498A IPC and U/s 3/4 D.P. Act, Police Station Kishani, District Mainpuri, pending in the court of A.C.J.M. Ist, Mainpuri to the competent court of District Auraiya. Concededly, the applicant herself lodged the F.I.R. at Mainpuri and is seeking transfer to Auraiya on the ground that after registration of the case, she shifted to her parental home at Auraiya. Further, reliance is placed upon on a medical prescription dated 28th February, 2018 to contend that the applicant- complainant is suffering from Gynecological problem. The medical prescription is seven years old and does not indicate any ailment. The other ground raised for transfer of trial is also insufficient. Dismissed.
