Petitioners’ claim for promotion to the post of Forest Guard was rejected vide order dated 15.2.2022 on the ground that the post of Forest Guard to which promotion is being claimed has been declared as dying cadre. 4. Petitioners contend that a proposal was submitted to the State Government by the Watershed Department for reviving the post of Forest Guard, which is still pending. 5. The reason for rejection of petitioner’s claim does not call for any interference as promotion can be made only against a post, which is still alive. 6. Since the post of Forest Guard is no more alive and has been declared as dying cadre, therefore, there cannot be a direction to promote the petitioner as 2025:UHC:11274 Forest Guard. 7. Since the proposal for reviving the post is reportedly pending consideration before the State Government, therefore, the writ petition is disposed of with a direction to the Secretary, Forest Department to consider the proposal for revival, as per law, within six months from the date of presentation of certified copy of this order.
