Of Secondary Education And 4 Others Counsel for Petitioner :- Avinash Chandra,Pravin Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Abdul Moin,J. Heard learned counsel for the petitioner and learned Standing Counsel for respondents no. 1 to 2. No notice be issued to respondents no. 3 to 5 taking into consideration the nature of order proposed to be passed. With the consent of learned counsel appearing for the contesting parties, the writ petition is being finally decided. The contention of learned counsel for the petitioner is that he had filed the instant writ petition praying for a writ of mandamus commanding the respondents to grant selection grade and promotional pay scale as well as to pay arrears of salary and to provide the pensionary benefits after refixation of pay. Subsequent to filing of writ petition the respondents vide order dated 07.12.2023 have granted selection grade to the petitioner and other benefits including promotional pay scale yet no decision has been taken pertaining to the arrears of salary and fixation of pension. Considering the aforesaid the writ petition is disposed of leaving it open to the petitioner to submit a representation to the respondent no. 2 i.e. District Lakhimpur Kheri for the purpose of grant of arrears of pay and fixation of his pay and for the purpose of pensionary benefits within 2 weeks from today. In case the said representation is made the respondent no. 2 shall consider the claim of the petitioner in accordance with law and the relevant rules considering the order dated 07.12.2023 which has has been passed in favour of the petitioner and an order in this regard would be passed within a period of six weeks from the date of submission of the representation along with certified copy of this order. It is made clear that this Court has not gone into the merits of the claim set forth by the petitioner. Order Date :- 5.3.2025 J. K.
