1. Heard Mr. M. H. Choudhury, learned counsel appearing for the accused petitioner as well as Mr. D. P. Goswami, learned Addl. P.P., Assam appearing for

2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioner, namely, Md. Waheb Ali @ Waheb Ahmed @ Abdul Waheb, praying for grant of bail in connection with GR Case No. 581/2012 (North Lakhimpur PS Case No. 299/2012 under Sections 302/201/34 IPC) pending before the court of learned JMFC, 1st Class, Lakhimpur North Lakhimpur.
3. It is submitted by the learned counsel for the petitioner that there was no allegation against the petitioner in the FIR but he was arrested on 06.06.2025 and has been in pre trial detention for 108 days. He was arrested pursuant to NBWA and vide order dated 06.06.2025 was remanded to custody by the learned court below.
4. Scanned TCR has been received.
5. Learned Additional Public Prosecutor has pointed out the statement of co- accused Hussain Ahmed and submitted that there was not much implicating material against the present petitioner.
6. Nevertheless, as the investigation has completed and charge-sheet has also been submitted, therefore, the petitioner should be allowed to go on bail at this stage.
7. Accordingly, it is provided that the accused petitioner, named above, shall be released on bail of Rs.30,000/- with one suitable surety of like amount to the satisfaction of learned concerned court subject to the following conditions that the petitioner: (a) shall be available for trial, if one commences.

8. Accordingly, this bail application stands allowed and disposed of.
