1. Heard Mr. A. K. Gogoi, learned counsel for the petitioner. Also heard Mr. D. P. Goswami, learned Addl. Public Prosecutor, Assam appearing for the State respondent.
2. This petition under Section 482 BNSS is filed for granting the
Page No.# 2/2 privilege of pre-arrest bail to the petitioner, namely, Dinesh Kalindi, apprehending arrest in connection with Mariani P.S. Case No. 94/2025 registered u/s 3(5)/316(5)/318(5) IPC.
3. The Case diary, as called for, is placed before the Court.
4. The allegation in the FIR dated 26.06.2025 is that the present petitioner who is stated to be the President of the concerned tea garden located in the jurisdiction of Mariani demanded Rs.10,000/- from the informant for restoring his job in the Estate.
5. Mr. D. P. Goswami, learned Addl. Public Prosecutor, submits that in the meantime, investigation completed and charge-sheet has been submitted.
6. Accordingly, the interim pre-arrest bail granted vide order, dated 04.08.2025 is hereby made absolute, subject to the following conditions- (i) That the petitioner shall be available for trial, if one commences; (ii) He shall not hamper or tamper with evidence.
7. This disposes of the anticipatory bail application.
