…...... 06/ 15.04.2025:
Heard, learned counsel for the petitioner and learned counsel for the State. This anticipatory bail application under Sections 438 and 440 of the Cr.P.C. has been preferred by the petitioner apprehending his arrest for the offences under Sections 376(2)(n) & 493 of IPC. From the argument advanced by the petitioner, the informant and the State and also from the case diary, it is apparent that on the pretext of marriage sexual relationship developed between the informant and the accused. Admittedly, both of them are major. Further, from the statement of the mother of the victim, it is clear that there was love affair between this petitioner and the victim, but they separated. After separation, the victim got married to someone else, but that person left her as it is alleged that he got information about the relationship between the petitioner and the informant. After the informant was left by her husband, she returned to her paternal home where again this relationship developed and it is alleged that this petitioner later on refuse to marry her. Considering the nature of allegation and the fact that both of accused and informant are major, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the anticipatory bail stands allowed. The petitioner, above named, is directed to surrender before the learned Court below within
2025:JHHC:11276 four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rs.
Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Giridih in connection with Giridih (M)/ Mufassil P.S. Case No.56 of 2024 subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
